Right of withdrawal

Pursuant to Art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Terms and therefore from the purchase contract for any reason, without having to give reasons and without any penalty, within 15 (fifteen) calendar days from the date of receipt of the products.

To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send FLAVIO CASTELLANI a notice to that effect, within the indicated time limits, to the following email address: sales@flaviocastellani.it, or by downloading and completing the form below.

Only returns with DHL or Bartolini are accepted.

The goods must be returned intact, complete with all their parts and in the original packaging (bags and boxes), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, with ordinary diligence, without signs of wear or dirt, taking care not to leave traces of makeup and/or fragrances (therefore the returned goods must not have been worn, except for trying on the garment to evaluate fit), in compliance with the conditions set out below:

the right of withdrawal may apply to the purchased product in its entirety; it is not possible to withdraw only from part of the purchased product (e.g. accessories, complements, etc.);
for the withdrawal to be possible, the product must be intact, clean and odourless and returned in its original packaging, complete in all its parts (including packaging and any accompanying documentation and accessories: labels, tags, tags, seals, etc.);

in case of damage to the item during transport, FLAVIO CASTELLANI will notify the Customer, so that the Customer can promptly file a complaint against the courier they chose and obtain the related refund; the product will then be made available to the Customer, at the same time cancelling the withdrawal request;

FLAVIO CASTELLANI will not be liable in any way for damage, theft or loss occurring during or in connection with the return shipment.

FLAVIO CASTELLANI will refund the Customer the full amount already paid, net of any additional shipping costs pursuant to Art. 56, paragraph 2, of Legislative Decree 21/14, within 15 (fifteen) working days from the moment the goods are received at our premises, by reversing the charged amount, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. In any case the Customer will bear no cost as a consequence of such refund. FLAVIO CASTELLANI may suspend the refund until receipt of the returned product or until the Customer proves they have correctly shipped the product, whichever is earlier.

In any case, the Customer will forfeit the right of withdrawal in cases where FLAVIO CASTELLANI ascertains that:

the returned product shows clear signs of use, dirt or odours;
the returned product and/or its accessories, and/or its packaging are not intact; the product is missing its external packaging and/or original internal packaging;
the product is missing integral elements of it and/or accessories (e.g. closures, laces, buckles, etc.).
In case of forfeiture of the right of withdrawal, FLAVIO CASTELLANI will return the purchased product to the sender, charging the shipping costs to the sender and, if already refunded, the price of the product.
